End User License Agreement

The Gun Log mobile application and website (collectively, the "Licensed Application") are licensed, not sold, to you. Your use of the Licensed Application is subject to the terms and conditions of this End User License Agreement ("EULA"). By downloading, installing, or using the Licensed Application, you agree to the terms of this EULA.
The Gun Log ("Application Provider") reserves all rights in and to the Licensed Application not expressly granted to you under this EULA.
a. Scope of License
The Application Provider grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Licensed Application on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. You may not:
- Distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time
- Rent, lease, lend, sell, redistribute, or sublicense the Licensed Application
- Copy (except as permitted by this license and the Usage Rules), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part thereof
If you sell or transfer your Apple device to a third party, you must first remove the Licensed Application from the device.
b. Subscriptions
Some features of the Licensed Application require a paid subscription. If you purchase a subscription:
- Payment will be charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription rate
- You can manage and cancel your subscriptions by going to your Account Settings in the App Store after purchase
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription
c. Consent to Use of Data
You agree that the Application Provider may collect and use technical data and related information — including but not limited to technical information about your device, system and application software, and peripherals — that is gathered periodically to facilitate the provision of software updates, product support, and other services to you related to the Licensed Application. The Application Provider may use this information to improve its products or to provide services or technologies to you, as long as it is in a form that does not personally identify you. Your use of the Licensed Application is also subject to the Application Provider's Privacy Policy.
d. User Content
You retain ownership of all data you enter into the Licensed Application, including information about your firearms, ammunition, components, and range sessions. By using the Licensed Application, you grant the Application Provider a limited license to store, process, and display your data solely for the purpose of providing the Licensed Application to you.
e. Termination
This EULA is effective until terminated by you or the Application Provider. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you shall cease all use of the Licensed Application, and destroy all copies, full or partial, of the Licensed Application. The Application Provider may also terminate your account and delete your associated data in accordance with the Privacy Policy.
f. External Services
The Licensed Application may enable access to the Application Provider's and/or third-party services and websites (collectively, "External Services"). You agree to use the External Services at your sole risk. The Application Provider is not responsible for examining or evaluating the content or accuracy of any third-party External Services and shall not be liable for any such third-party services. You should consider the terms and privacy policies of any third-party services before using them.
g. No Warranty
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION AND ANY SERVICES PERFORMED OR PROVIDED BY THE LICENSED APPLICATION ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, AND THE APPLICATION PROVIDER HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE LICENSED APPLICATION AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS.
h. Limitation of Liability
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL THE APPLICATION PROVIDER BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE LICENSED APPLICATION, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF THE APPLICATION PROVIDER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. In no event shall the Application Provider's total liability to you for all damages exceed the amount of fifty dollars ($50.00).
i. Export Compliance
You may not use or otherwise export or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which the Licensed Application was obtained. In particular, but without limitation, the Licensed Application may not be exported or re-exported (a) into any U.S.-embargoed countries or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List.
j. U.S. Government End Users
The Licensed Application and related documentation are "Commercial Items", as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation", as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. The Licensed Application is being licensed to U.S. Government end users only as Commercial Items and with only those rights as are granted to all other end users pursuant to the terms and conditions herein.
k. Governing Law
This EULA shall be governed by and construed in accordance with the laws of the State of California, United States, excluding its conflicts of law rules. Any legal action or proceeding arising under this EULA shall be brought exclusively in the courts located in California.
